McKenna (McJack): Manny Pacquiao claims Floyd Mayweather Jr. has not been truthful with regard to the defamation lawsuit his attorneys have brought against him. Manny filed papers today in Nevada asking that he be declared the winner in the ongoing legal battle with Mayweather.

In the lawsuit Manny Pacquiao alleges that Floyd Mayweather Jr. falsely accused him of using steroids. According to the legal papers filed, the Pacquiao camp offered up twenty four dates for Floyd to take the deposition but Mayweather has come up with numerous excuses as to why he can’t take the deposition. The primary excuse that Floyd has come up with is that his training schedule for his upcoming fight with Victor Ortiz is too intense and will not leave him adequate time to prepare with his attorneys to take the deposition.

Pacquiao’s attorneys have shot that excuse down alleging that on the days Mayweather was supposed to be training he was seen partying in nightclubs in Las Vegas and Atlanta.

Manny is tired of waiting for Floyd to take the deposition and wants the judge to issue a default judgment in his favor.

There is no word as to what the dollar amount Pacquiao would expect to receive if he wins the defamation lawsuit against Mayweather. Oscar De La Hoya and Golden Boy Promotions and their top executives had also been named in the lawsuit, but they issued an apology and a written statement covering all bases on May 31, 2011. The settlement paved the way for Golden Boy and Manny Pacquiao’s promoter Bob Arum, CEO of Top Rank to work together in harmony. The settlement also left Floyd Mayweather holding the bag, so to speak as the only defendant in the lawsuit.

Pacquiao attorney Dan Petrocelli would not disclose the terms of the settlement with Golden Boy Promotions. Petrocelli also said at the time of the settlement with Golden Boy that Pacquiao’s defamation lawsuit against Mayweather would continue.

Petrocelli is a hard nosed high profile attorney who is best remembered for winning the 33.5 million dollar Judgment in the civil case against O.J. Simpson in the 1994 slayings of Ron Goldman and Nicole Brown Simpson.

It is thought by many that the dream fight between Manny Pacquiao and Floyd Mayweather Jr. cannot happen until the defamation lawsuit is settled.
